Former Trial Lawyer John Edwards on Medical Malpractice - Calls For End To Frivolous Lawsuits

Presidential candidate John Edwards, a former North Carolina trial lawyer and former United States Senator, has set forth his position on the topic of medical malpractice reform. In a positon paper released to today he called for an end to frivolous lawsuits. Edwards will require lawyers to have an expert testify that actual malpractice has occurred before bringing a suit. There will be mandatory sanctions for lawyers who file frivolous cases, and any lawyer who files three frivolous cases will be forbidden from bringing another suit for the next 10 years. The trial lawyers organization, AAJ, takes the position that there is no need for medical malpractice reform.

Mike,
I've attached a link to my blog on this plan. For lawyers in NJ and in PA, I don't see that this is too much of a burden. This is just what responsible trial lawyers have been doing for years.
