Minnesota Teens Charged with Nursing Home Abuse While Friends Looked On

According to a criminal complaint filed Monday, several female high school students who worked together as part-time aides at Albert Lea, Minnesota’s Good Samaritan nursing home have been accused of abusing the residents they were hired to care for.

Reported abuses include taunting seven different residents, spitting on them and in their mouths, and poking and rubbing their genitals.

Two of the young women, Brianna Marie Broitzman, 19, and Ashton Michelle Larson, 18, were old enough at the time of the alleged abuse to be charged as adults—Broitzman for 11 counts and Larson for 10. The six others involved were all 17 at the time, and have thus only been identified by birthdates and initials. Two of these young women will be tried as juveniles for abusing the residents; the other four have been charged in juvenile court for failing to report the maltreatment they witnessed.

Monday, Broitzman and Larson were charged with fifth-degree assault, abuse of a vulnerable adult with sexual contact, abuse of a vulnerable adult by a caregiver, disorderly conduct, and failing to report suspected maltreatment—all gross misdemeanors, with a maximum penalty of one year in jail and a $3,000 fine per count.

If found guilty, "they most likely will face suspended jail sentences and probation, so they'd have the threat of jail hanging over them if they get in more trouble," said Freeborn County Attorney Craig Nelson, who filed the charges Monday.

Since summer, Nelson has said that prosecuting the aides could prove difficult because the evidence is largely based on their own statements and those made by another aide who blew the whistle to the home's administrators while she was being fired for swearing in front of a resident. That aide was among those charged as a juvenile. –Warren Wolfe, Minneapolis Star Tribune

Allegations against the teens first went public in August, after state health department inspectors found that four of them had abused over a dozen residents in efforts to make “work fun.”

The abusive acts allegedly occurred between Jan. 1 and May 1, 2008. When the Good Samaritan learned of the health department’s allegations in May, it fired the four accused aides.

As a Lvn and former CNA, I am completely speechless over what these teens did and the reasons behind it. However I quickly regained my speech when i noticed they will only recieve probation and maybe a year in jail and fines?? Seriously?!?! I feel the judge should set them as an example to the rest of the world that this is unaccepatble behavior and there is no excuse. They are getting a slap on the hand for what they did..UNACCEPTABLE!Somethings wrong with this entire picture! These teens need to spend "ALOT" of time in jail/prison and NEVER be allowed to work in the health field AGAIN!!Wow, I feel sorry for they day they grow old and KArma comes a knocking on their door. MAy god have MERCY ON THEIR SOULS!

I learned of this incident on Wednesday 12/03/08 while listening to WTMJ Radio Milwaukee, Wisconsin. I am the owner of a franchise company that provides Non-Medical assistance for seniors in their homes.

I was outraged to hear of these allegations, and after reading this blog regarding their potential punishment, I am even MORE OUTRAGED.

This behavior is UNACCEPTABLE ANYWHERE, ANYTIME. These individuals need to made an example of what will happen when you willingly, without remorse decide to abuse these defenseless PEOPLE. These residents are real people, not toys to be played with and abused.

Let's not blame technology, movies,or TV. Put blame and responsibility where it belongs... with These Bullies as they seemingly premeditated these actions as they had the undivided attention of their friends.

This is not a frivilous complaint. Please do not bury it under the rug, and then find out where was their supervision.

Wow, misdemeanors for sexually assualting vulnerable elderly patients they were paid to care for? Why, because they are young white women and this could possibly ruin their future if charged with a felony? Now if the alleged criminals were young white men or even a minority, would the charges be the same? How is it not a felony to put your finger in someone's rectum, rub their genitals with and mimick a sex act by climbing in bed with them and humping? Would it be a felony if the victims were children? Okay, treat the victims as children, the word does say "once a man twice a child."

Ah come on. They gave some old dudes boners and did some intense flirting with these silver foxes. Shouldn't they be rewarded for charitable foreplay on these poor elderly gents who gave up on any kind of funny business years ago?

As someone who has a mother with Alzheimers, I am DISGUSTED by this story and feel these so called people should be charged with felonies. As an RN I am wondering where the supervision owas? This entire home needs to be investigated and CLOSED DOWN. I hope to God these residents have family members who will go after these criminals with every high powered attorney they can find. If I were an attorney, I would take the cases pro bono. God help these criminals. Their karma will catch up to them.

I am ashamed to say that I grew up in that area and have family in the area. Thank God that I don't have children or family in the Albert Lea school system if they can't teach their young people compassion. How did these girls ever complete their CNA classes. Didn't the instructors pick up any vibes by the girls actions during practicals.
Good Sam is a or was a good nursing home. My grandmother lived their for several years before her death at 101. I am confident that she had good care. She was also a resident at the home over 10 years ago.
These girls should not get the aniticipated slap on the wrist. They should be prosecuted and at the very least put in a mental facility where they loose their freedom for several years. My gut feeling is that these girls feel no remorse and should be treated accordingly.

It is horrifying to think that young girls could be so cruel to helpless vulnerable seniors. However, one thing I would like to point out is that there are many caretakers in nursing homes across the world who would never stoop so low. I work in a nursing home, and I see wonderful people doing wonderful things each and every day for our dear residents. These mean-hearted girls need to be punished for what they did, and hopefully receive counseling to find out why they would think it's funny entertainment. Meanwhile though, let's keep in mind that most caretakers truly do provide excellent and loving service to those in need.

Anita is correct. There are many, many caretakers who take their thankless job seriously and really do help those in their care. At this holiday season we owe them a debt of gratitude. Only those nursing homes and caretakers who abuse their patients, drop them, cause bedsores to happpen, or provide negligent care are the ones who should be targets of lawsuits. It's all about accepting personally responsibility for the harmd they cause.
